Overview
Manage a caseload of contract, probate, commercial surety and fidelity claim files. This includes investigating, examining and negotiating assigned claims through telephone, personal contact and/or written correspondence and concluding them to settlement or where appropriate, a denial. Preserve subrogation rights and initiate recovery where appropriate. Ensure claims are processed within company policies, procedures, and their individual prescribed authority by maintaining exceptional standards of performance. All job duties and responsibilities must be carried out in compliance with applicable legal and regulatory requirements.
Responsibilities
- Review bond form, claim notices and documentation submitted by claimants to determine whether there is coverage for the claim.
- Communicate with the bond principal and other witnesses to determine whether there are any legitimate defenses.
- Communicate claim status and negative trends of accounts with underwriters and agents to assure current underwriting decisions are made with full knowledge of the risk.
- Retain and supervise outside counsel or consultants as needed to assist in the examination and adjustment or litigation of the claim.
- Identify whether additional information is needed from claimant or principal to make effective decision on claim
- Establish reserves on claims within authority and make recommendations on reserves on claims exceeding authority.
- Demand collateral and persuade surety's principal to exonerate surety.
- Negotiate, pay or deny claim.
- On paid claims, negotiate release and assignment and conduct analyses on recovery potential and initiate collection actions accordingly.
- Must be able to drive an automobile to travel within territory. Travel represents approximately 10-25% of employee's time and a valid driver's license.
Qualifications
Knowledge and Requirements
- Excellent written and oral communications skills. Patience. Attention to details and procedures. Knowledge of construction, contract, fiduciary and bankruptcy legal concepts. Ability to look up statutes and regulations to understand bonded obligations.
- Must have valid state-issued driver's license in good standing and be able to drive an automobile.
Education and Experience
- College degree preferred. Paralegal certification helpful. Experience in a commercial law firm or construction company helpful.
- While not required, AFSB, advanced knowledge in accounting, contract law, construction law and fiduciary law are extremely helpful.

The actual base salary is based on geographic location, and the range is representative of salaries for this role throughout Selective's footprint. Additional considerations include relevant education, qualifications, experience, skills, performance, and business needs.
Pay Range
USD $84,000.00 - USD $127,000.00 /Yr.
