Introduction

The Clerk of the Circuit Court is a constitutional officer, and the duties of this office are mandated by the Code of Virginia. The Clerk's Office provides multiple statutory and local services for residents, business professionals, legal professionals, judges, public safety officials, a variety of state and local government agencies, and the towns of Loudoun County. The Clerk of the Circuit Court serves as the recorder of deeds and probate judge, issues marriage licenses and is the official court administrator for all civil and criminal court cases. In this latter capacity, the Clerk creates and maintains all court files and records, prepares court orders and jury lists, contacts jurors and issues summons and court processes.


Job Summary

The Clerk of Circuit Court is seeking qualified applicants for a Probate Specialist. The successful candidate will respond to all probate contacts by phone, email, or in person, as well as schedule and conduct daily probate hearings as directed by the Probate Manager. Ensures appropriate and timely processing of legal documents, including wills, other related documents, and court orders; oversee reports and paperwork received from the Commissioner of Accounts office, including inventories, accountings, show cause orders, foreclosure papers and other legal documents required in fiduciary procedures.

This individual will perform all functions required of a Probate Judge on behalf of the Clerk in fiduciary matters including, the probate of wills, qualification of executors or administrators for personal estates, and qualification of guardians, conservators and testamentary trustees. The Probate Specialist must be knowledgeable of over 200 statutes in the Code of Virginia related to fiduciary actions and will also conduct legal research to resolve probate issues using the Code of Virginia and other legal resources. This position will also appoint and/or qualify Executors/Administrators, Testamentary Trustees for a decedent's estate, Conservators and Guardians of Incapacitated Adults, and Guardians of Minors.

Other duties include, but are not limited to, respond to complex questions and assist attorneys with inquiries involving probate matters; provide assistance to customers who are unfamiliar with probate procedure and terminology by explaining various probate forms and bond requirements; book indexes, images and public access computers; researches and develops probate guides and information related to probate procedures for distribution to attorneys, citizens, and staff; and assists Probate Manager in development of presentations for education programs.

Hiring salary is commensurate with experience.


Minimum Qualifications

Associate degree; three (3) years of related work experience, or equivalent combination of education and experience. Continuing legal education from the Virginia State Bar or VCCA Career Development Program is desired.

Experience with real estate and/or fiduciary experience preferred.
